Terms of Service
Last updated 2026-09-07
These Terms of Service (the “Terms”) are a binding agreement between you (“Merchant”, “you”) and MultiCoinPay Inc (“MultiCoinPay”, “we”, “us”), which operates the MultiCoinPay non-custodial crypto payment gateway (the “Service”). By creating an account, registering a receive key, or using the API or checkout, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- Service — the MultiCoinPay software, API, hosted checkout pages, and merchant console.
- Merchant — the business or individual that registers an account and accepts payments through the Service.
- Customer — a person who pays a Merchant through a MultiCoinPay checkout.
- Receive key — the watch-only extended public key (xpub) or wallet address a Merchant supplies, from which receiving addresses are derived.
- Non-custodial — funds settle directly to addresses the Merchant controls; MultiCoinPay never holds, controls, or can move funds.
2. Eligibility & acceptance
You must be at least 18 years old and able to form a binding contract, and you must not be located in, or a resident of, a jurisdiction subject to comprehensive sanctions, or be a person with whom dealings are prohibited under applicable sanctions law. By accepting these Terms you represent that you meet these requirements and that all information you provide is accurate. You are responsible for ensuring that your use of the Service is lawful where you operate.
3. The service is non-custodial
MultiCoinPay is non-custodial. Receiving addresses are derived from a Merchant-supplied watch-only extended public key (or, for Solana, the Merchant’s own wallet). MultiCoinPay never holds, controls, commingles, or has the ability to move Merchant or Customer funds. Payments settle directly on-chain to addresses the Merchant controls. MultiCoinPay observes the relevant blockchains and reports payment status; it is a technology and messaging provider, not a bank, money transmitter acting as principal, custodian, exchange, or party to any payment. You are solely responsible for the receive keys you register and for the security and correctness of the wallet they derive.
4. Accounts & security
You are responsible for safeguarding your login credentials, API keys, and webhook secrets, and for all activity under your account. Notify us promptly of any suspected unauthorized access. You must keep your contact details current. We may require re-authentication or additional verification where necessary to protect the Service or comply with law.
5. Merchant obligations & acceptable use
You are solely responsible for your own regulatory compliance, including any money-transmission, virtual-asset-service-provider, KYC/AML, consumer-protection, licensing, and tax obligations that apply to your business and jurisdiction. You must:
- only accept payments for lawful goods and services you are authorized to sell;
- publish your own refund, cancellation, and dispute policy to your Customers, and honour it;
- accurately describe prices and what the Customer is paying for;
- not use the Service to facilitate any activity listed in Section 6.
MultiCoinPay is a tool for accepting payment; it does not verify the legality of your underlying business, and using the Service does not transfer your legal obligations to us.
6. Prohibited uses
You may not use the Service to facilitate, and you may not accept payments in connection with: transactions with sanctioned persons, entities, or comprehensively-sanctioned jurisdictions; money laundering, terrorist financing, or sanctions evasion; fraud, theft, or deceptive practices; the sale of unlawful goods or services (including illegal drugs, weapons where prohibited, stolen data, or child sexual abuse material); intellectual-property infringement; unlicensed financial, gambling, or securities activity where a licence is required; or any attempt to interfere with, reverse the intended controls of, or overload the Service. We may investigate suspected violations and cooperate with law enforcement.
7. Compliance, sanctions screening & geographic restrictions
The Service screens payer source addresses against sanctions lists (including U.S. OFAC lists) on a fail-closed basis: a payment from a screened address is placed in a blocked state and is not credited or surfaced as settled. We may restrict, throttle, or refuse access by geography, IP, or risk signals, and may add jurisdictions to a block list. Screening is automated, based on third-party list data, and is not a guarantee; it does not discharge your own compliance obligations. We may retain sanctions-screening results for the period required by applicable law (see the Privacy Policy).
8. Fees
Fees, if any, are those presented to you by the operator of the deployment you use. For self-hosted deployments of the open software, MultiCoinPay may charge no fee and the operator sets its own terms. Blockchain network fees, exchange withdrawal fees, and FX spreads are determined by third parties and are not set or received by MultiCoinPay. Any fees are exclusive of taxes, which are your responsibility. Where fees apply, the operator will disclose them before you incur them.
9. Blockchains, third parties & irreversibility
The Service depends on public blockchains and third-party infrastructure (RPC providers, FX price feeds, and similar) that MultiCoinPay does not control. Blockchain transactions are generally irreversible; network congestion, chain reorganizations, fork events, RPC outages, mempool policy, or price volatility can delay, alter, or affect settlement and quoted rates. Rate quotes are time-limited and expire. You are responsible for reconciling payments against the webhooks and dashboard, and for handling underpaid, overpaid, late, or superseded payments in accordance with your own policy.
10. Intellectual property & licence
The Service, including its software, design, and documentation, is owned by MultiCoinPay or its licensors and is protected by intellectual-property law. Where the software is provided to you under a separate open-source or self-hosting licence, that licence governs your rights in the code; these Terms govern your use of the hosted Service and API. You retain all rights in your own content, keys, and data. You may not remove proprietary notices, or use MultiCoinPay’s name or marks without permission except to accurately describe integration.
11. Refunds & disputes
Because the Service is non-custodial, MultiCoinPay does not process refunds and is not a party to any transaction between a Merchant and its Customer. Refunds, chargebacks, and disputes are solely between the Merchant and the Customer. Where a payment arrives late, underpaid, overpaid, or on a superseded invoice leg, MultiCoinPay surfaces it to the Merchant (in the dashboard and via webhook events such as payment.paid_after_expiry) so the Merchant can credit or refund the Customer at its discretion. Merchants must publish and honour their own refund policy. Customer-facing checkout wording that references a credit or refund refers to the Merchant’s obligation, not MultiCoinPay’s.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, that defects will be corrected, or that settlement, screening, or FX data will be complete or accurate. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MULTICOINPAY AND ITS OPERATORS, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR LOST FUNDS ARISING FROM MIS-REGISTERED OR COMPROMISED KEYS, CHAIN REORGANIZATIONS, THIRD-PARTY RPC/PROVIDER FAILURES, PRICE VOLATILITY, OR CUSTOMER ERROR. OUR AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US FOR THE SERVICE IN THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (WHICH, FOR SELF-HOSTED SOFTWARE, MAY BE ZERO) OR (B) USD 100. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
14. Indemnification
You will indemnify and hold harmless MultiCoinPay and its operators from and against any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your goods or services, your breach of these Terms or of applicable law, or your violation of any third-party right.
15. Suspension & termination
We may suspend or terminate your access, with or without notice, if you breach these Terms, use the Service unlawfully, or create a security, legal, or compliance risk, or as required by law. You may stop using the Service at any time. On termination, the provisions that by their nature should survive (including Sections 5–6 and 11–17) will survive. For a self-hosted deployment, the operator controls account lifecycle for that deployment.
16. Changes to the service & to these Terms
We may modify the Service and update these Terms. The “Last updated” date reflects the current version; where a change is material, we will take reasonable steps to notify Merchants. Your continued use after a change takes effect constitutes acceptance of the updated Terms.
17. Governing law & dispute resolution
These Terms are governed by the laws of the Cayman Islands, without regard to conflict-of-laws rules. Subject to any mandatory consumer or local-law rights you may have, you and MultiCoinPay will attempt in good faith to resolve any dispute informally first, and any dispute not resolved will be subject to the exclusive jurisdiction of the competent courts of the Cayman Islands. Nothing here waives rights that cannot be waived under applicable law.
18. Miscellaneous
If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure due to events beyond its reasonable control. These Terms, together with any policies referenced here, are the entire agreement between you and MultiCoinPay regarding the Service.
19. Contact
Questions about these Terms: [email protected]. For a self-hosted deployment, contact the operator via the support channel they publish.
